Acceptance of License Agreement

By downloading, installing, or using the Elevate News mobile application (the "App"), you ("User" or "Licensee") agree to be bound by this License Agreement (the "Agreement"). If you do not agree to the terms of this Agreement, do not install, use, or access the App.

Grant of License

Elevate News ("Licensor") grants the Licensee a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for personal, non-commercial purposes in accordance with the terms set forth in this Agreement and the Terms and Conditions available at https://elevatenewsapp.com/terms-of-service.

Restrictions on Use

The Licensee agrees not to, and will not permit others to:

  • Modify, translate, adapt, or create derivative works or improvements, whether or not patentable, of the App;

  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the App or any part thereof;

  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the App, or any features or functionality of the App, to any third party;

  • Use the App to engage in unlawful activities or in a way that could damage, disable, or impair the App’s functionality.

Intellectual Property

  • Ownership: All content within the App, including but not limited to text, graphics, logos, and images, is owned by Elevate News or licensed from third-party providers such as NewsAPI.AI, Adobe Stock Photos, and Death to Stock Photos. This content is protected by copyright and other intellectual property laws. Licensee acknowledges that no title to the intellectual property in the App is transferred to Licensee under this Agreement.

  • Usage Restrictions: The Licensee may only use content from the App for personal purposes and may not reproduce, distribute, or create derivative works from any content unless expressly permitted under this Agreement or by Elevate News.

  • Sharing of Content: Licensee may use the in-app sharing feature to share articles, which primarily provides links to the App Store. Licensee is not permitted to share content in any other manner unless allowed by Elevate News.

  • Trademarks: All company names, product names, logos, and service marks displayed in the App are owned by their respective holders. The display of these marks does not imply any endorsement, affiliation, or partnership with Elevate News unless explicitly stated.

User Data & Privacy

Elevate News respects user privacy. By using the App, you agree to the collection, use, and sharing of your data as outlined in our Privacy Policy, which can be accessed at https://elevatenewsapp.com/privacy-policy.

  • Data Collection: We collect personal data such as email addresses and profile pictures through services like Google’s Firebase, and third-party sign-ins (Apple and Google).

  • Account Deletion: If you wish to delete your account, which means removing your login information, please click here or email us at info@elevatenewsapp.com. The deletion process may take up to 30 business days to complete.

AI Features Disclaimer

The ‘Summarize with AI’ feature and Positivity Ranking Score in the App are powered by OpenAI’s ChatGPT. While we strive for accuracy, Elevate News is not responsible for any inaccuracies or misinformation provided by these AI features. Users are encouraged to verify content from external sources when making decisions based on AI-generated content.

Termination

This Agreement is effective as of the date the Licensee first downloads or uses the App and will remain in effect until terminated by either the Licensee or Licensor.

Termination by Licensee: The Licensee may terminate this Agreement at any time by deleting the App from all devices.

Termination by Licensor: Elevate News may terminate this Agreement at any time, with or without notice, if the Licensee violates any term of this Agreement. Upon termination, Licensee must cease all use of the App and delete all copies from all devices.

Termination of this Agreement does not affect any rights or liabilities accrued prior to termination. Upon termination, Elevate News will also follow its data retention and deletion policies outlined in the Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, Elevate News shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangible losses arising out of or related to the Licensee’s use or inability to use the App, even if advised of the possibility of such damages.

Disclaimer of Warranties

The App is provided on an “as-is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Elevate News does not warrant that the App will be uninterrupted, error-free, or secure. Licensee acknowledges that use of the App is at their sole risk.

Governing Law and Dispute Resolution

This Agreement will be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.

Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts located in [Your Jurisdiction]. Licensee agrees to resolve any dispute amicably before seeking legal recourse.

Modifications to the Agreement

Elevate News reserves the right to modify this Agreement at any time. Any changes will be effective upon posting an updated version of the Agreement within the App and/or on our website. Continued use of the App after any such changes constitutes Licensee’s consent to the updated terms.
